If we apply to the court for a liability order you will incur court costs.

At the hearing the magistrates can only consider two issues when deciding if a liability order should be granted:

• Have we issued the required notices
• Has the debt been paid in full

If the court is satisfied we have issued the required notices and the bill has not been paid in full, then it is required to issue the liability order.

A liability order gives us the authority of the court to recover the debt.

If a liability order is issued, the debt may be passed to a Bailiff (enforcement agent) to collect. As well as the court costs you will also have to pay bailiff fees. They may take your goods to sell at auction. Or we may take money straight from your earnings or benefits.
