What information do we need?

Torbay Registration Service is the Data Controller for personal data collected for the purpose of registering life events such as births, deaths and marriages within Torbay.  We also process personal data for the purpose of conducting Citizenship Ceremonies. Our ICO registration number is ZA234109. 

The processing of your personal information for this purpose is necessary under our legal obligations as set out in the following:

  • Births and Deaths Registrations Act 1953
  • The Marriage Act 1949
  • The Registration and Marriage Regulations 2015
  • The Civil Partnership Act 2004
  • Civil Partnership (Registration Provisions) Regulations 2005
  • The Nationality, Immigration and Asylum Act 2002
  • British Nationality (General) Regulations 2003

The information you provide may also be used so that we may contact you for the purpose of carrying a satisfaction survey, the Registration Service is required to provide anonymised information to the General Register Officer, the lawful basis for this process is that this is necessary for a task carried out in the public interest.

Do we share your information?

We do not trade personal data for any commercial purpose and will only disclose your personal information if we have a lawful basis to do so or if we have your consent.  

We will share information relating to births, deaths and marriages with the General Register Office because we have a legal obligation to do so under the Acts listed above.  Statistical information will also be shared with the Office for National Statistics under the requirements set out in the Population Statistics Act 1938.

Information regarding citizenship is provided to the Registration Service from the Home Office and then we notify the Home Office to confirm a ceremony has taken place.

How long do we keep your information?

We will hold your information on an electronic database and in the Official Register indefinitely. Your personal information will not be subject to any overseas transfers.

What information do we need?

Where an individual is unable to use the NHS Test and Trace app, a manual log of contact information will be required for each individual attending wedding ceremonies officiated by Torbay Registrars. The information we will record is as follows:

  • Full name
  • Contact telephone number

If you do not have a telephone number you will be asked to provide a postal address or an email address. We will also record your time of entry and where possible your time of departure.

Why we need it?

The UK is currently experiencing a public health emergency as a result of the coronavirus (COVID-19) pandemic. It is therefore crucial that organisations take a range of measures to keep everyone safe.  The easing of social and economic lockdown measures following the COVID-19 outbreak is being supported by NHS Test and Trace. The Department of Health and Social Care has asked organisations to support this service by keeping a temporary record of visitors for 21 days.

Our Lawful basis for collecting and sharing this information is therefore:

  • Processing is required for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

Do we share your information?

We may share the personal information collected as stated above in the event of a local outbreak of COVID-19 with the following:

  • NHS Test and Trace Service
  • Public Health England
  • Torbay Council’s Public Health Team

Outside of the above we will only disclose your personal information if we have a lawful basis to do so, for example for the prevention and detection of crime, or if we have your consent.  We do not trade personal data for any commercial purpose,

How long do we keep your information?

Information which is collected and stored solely for NHS Test and Trace will be retained for 21 days after which time it will be securely destroyed.
