Licensing Act 2003: Application for Review of a Premises Licence – Section 51 of the Licensing Act 2003

Notice is given that an application has been made to Torbay Council for a review of the premises licence in respect of the premises shown below.

Any interested party or responsible authority may make representations in respect of the application which must be provided, in writing, to the Principal Officer Licensing and Public Protection, Torbay Council, Town Hall, Castle Circus, Torquay TQ1 3DR or by email to licensing@torbay.gov.uk by the date shown below.

It is an offence knowingly or recklessly to make a false statement in connection with an application and the maximum fine for which a person is liable on summary conviction is £5000

Premises: Below Decks, 3 to 4 Beacon Quay, Torquay, TQ1 2BG

The Grounds for the application for review are as follows:  

The Prevention of Crime and Disorder, Public Safety and Prevention of Public Nuisance:  

Regular and repeated failure of the licence holders to comply with a condition on the premises licence which requires that customers do not loiter in the road.  

Numerous complaints, over a 3 year period, in respect of the licensing objectives The Prevention of Public Nuisance and Public Safety issues at music events that take place on a weekly or twice weekly basis throughout the summer months.

Complainants state the music is loud, and these events encourage a large crowd to congregate within the road, where they dance and drink alcohol provided in glass vessels, preventing or restricting vehicular access to the pier and slipway, with little to no supervision of customers by staff.

The area is frequently littered with glass vessels, plastic vessels and bottles that are not cleared on a regular basis by staff throughout the events.
