Appeal against a decision

What to do if you are not happy with a decision taken about your eligibility for funded social care.

If you are not happy with a decision taken you can appeal. This may be because you disagree with:

  • your eligibility for funded social care
  • your assessment
  • the amount of money given to you to meet your social care needs
  • your support plan

Making an appeal

An appeal is a way of asking for a review of a decision. There are a few steps:

  • contact the person who did your initial assessment to talk about your concerns
  • if you are still not happy with the decision you will need to contact PALS
Appeal against a decision
  • PALS will look at your appeal and check we have made the right decision
  • PALS will contact you to tell you the result of your appeal

If you are still unhappy

Once we have looked at your appeal if you are still not happy you can contact the Local Government and Social Care Ombudsman. You can do this at any time but, please note, that they will only usually investigate if you have allowed us to deal with the issue first.

If they decide to investigate, they will check that we have made decisions the right way.

Advocacy

If you need help to appeal please contact Devon Advocacy Services. They provide free and independent advocacy services for people over sixteen.
