Find out how to apply for a licence to sell things on the street.
A Street Trading Permit needs to be applied for in order to sell or expose goods/services for sale in public access areas. This includes areas which the public can access without payment. Details of areas prohibited or restricted can be found in our schedule below.
If you intend to sell food, you will need to register your food business. Planning consent may also be required in some situations, for example mobile food premises.
These restrictions will not affect trading from shops or the use of shop fronts on the highways. This is not classified as Street Trading, providing it is the same business, but you will need to apply for a highway projections licence.
If you want to trade in Torquay or Paignton Town Centre consent must be obtained from our colleagues in Community and Customer Services on 01803 208861, prior to applying for a street trading licence.
We can issue a variety of Consents, covering different trading periods from 1 day to 1 year.
Trading at a charitable fair may require Consent to cover the entire site and, provided that all the trading is for the benefit of the charity, no charge will be made. If commercial traders are involved, each will, on application, be charged an appropriate fee.

If an applicant applying for an event/events, applies for a number of days within a given time period, even if those days are not consecutive or not at the same location then the charge will be based upon total number of days applied for. However this cannot be done in retrospect.
# Local Community Street Trading Events (i.e. friend of park etc.) where the purpose is charitable, but where stall holders only pay a contribution for charitable purposes - (with agreement from Council) - applicant will pay half the fee listed in the traders fee table above e.g. if £400, then they will pay £200.
# Council Event, run by the Events Team (as opposed to an event supported by TBC) then fee will be half the fee listed listed in the trader fee table above.
Charitable Street Trading Events, where ALL money raised is for charitable purposes - Free (with agreement from Council)
It is in the public interest that we must process your application before it can be granted. You cannot provide, operate or undertake the licensable activity without a Consent. Though there is a legal obligation to issue the Consent, due to restrictions on where the Consent can be used, an officer will normally wish to speak to the applicant before issuing that Consent.

If the event is Charitable and all of the profit from these stalls or units will be donated to the Charity then a Charitable Street Trading Consent can be applied for. Please apply at least 21 days prior to the event taking place. There will be no charge for these Consents.
If the event is Charitable and all of the profits go to the Charity, but you have invited itinerant traders to come to the event to provide food and refreshments to persons attending the event they will need their own Street Trading Consent.
