Prior to consideration of the item in Minute 26 the press and public were formally excluded from the meeting on the grounds that the item involved the likely disclosure of exempt information as defined in paragraph 1 and 2 of Part 1 of Schedule 12A of the Local Government Act 1972 (as amended).)

Determination of an Application for the Grant of a Dual Hackney Carriage and Private Hire Drivers' Licence

To consider an exempt report on the above.

Minutes:

Members considered an exempt report in respect of an application for a dual Hackney Carriage and Private Hire Drivers Licence.  At the Hearing, the Applicant presented his application and responded to Members questions.

 

Decision

 

That the application for a Torbay Council Hackney Carriage and Private Hire Licence be granted.

 

Reason for Decision

 

Having carefully considered all the written and oral representations, Members resolved to grant the licence, despite initial reservations of the Applicant’s convictions, and in particular the circumstances surrounding the applicant’s conviction in 2010.  On hearing the Applicants oral representation, Members were reassured by the apparent remorse shown and the clear willingness to turn his life around and take his current responsibility seriously.  This demonstrated to Members a level of maturity expected by Members of a responsible person to hold such a licence.

That the application for a Variation to a Premises Licence in respect of Urban Edge Coffee, 54 Victoria Street, Paignton be granted as applied for, subject to the additional conditions proposed by the Safeguarding and Reviewing Team, as agreed by the Applicant.

 

Reason for Decision:

 

Having carefully considered all the written representations, Members resolved to grant the licence having been satisfied that the additional conditions would promote the licensing objectives and seek to alleviate the concerns raised by the Safeguarding and Reviewing Team.

 

In concluding, Members noted there were no representations in respect of this application from any residents or any other Responsible Authority other than the Safeguarding and Reviewing Team.
