Torbay Safeguarding Children Board

Representation received in respect of the Licensing Objectives ‘The Protection of Children from Harm.’

30 July 2013

 

Members were advised by the Senior Licensing Officer that the Applicant would not be attending the Committee and had sent an e-mail confirming acceptance of the proposed Conditions by the Torbay Safeguarding Children Board.

 

1)     No children under the age of 18 shall be allowed on the premises unless they are attending a private function or working on the premises in the capacity as a trainee; and

 

2)     All children under the age of 18 attending private functions must be accompanied by a responsible adult; and

 

3)     All trainees on site who are under 18 must be supervised by an adult tutor; and

 

4)     A proof of age policy for any customer purchasing alcohol who looks under 25 years of age.

 

Members had questions that could not be answered by the Senior Licensing Officer.

 

Decision:

 

That the application for a Premises Licence in respect of Eat That Frog, 89 Torquay Road, Paignton TQ3 2SE be deferred to enable the Applicant to attend and explain how the Premises will be run complying with the Licensing Objectives.

 

 

18.

Exclusion of the Press and Public

To consider passing a resolution to exclude the press and public from the meeting prior to consideration of the following item on the agenda on the grounds that exempt information (as defined in Part 1 of Schedule 12A of the Local Government Act 1972 (as amended)) is likely to be disclosed.

Prior to consideration of the items in Minutes 19 and 20 the press and public were formally excluded from the meeting on the grounds that the item involved the likely disclosure of exempt information as defined in paragraph 1 of Part 1 of Schedule 12A of the Local Government Act 1972 (as amended).

To consider an exempt report on an application for a Transfer for a Premises Licence.

Members considered a report for an application for a Transfer of a Premises Licence in respect of Clock Tower, 23 Torwood Street, Torquay TQ1 1ED.

The Premise is situated in the Cumulative Impact Area.

 

The Senior Licensing Officer advised Members that the Applicant was unable to attend the Committee and circulated an e-mail from the Applicant giving permission for the Applicant’s spouse to deal with any decisions.

 

Members sought clarification from the Applicant’s Legal Representative as to how long the Applicant would be overseas and expressed concern over the non-attendance of the Applicant to respond to the Representation received from the Police to enable them to consider both the Transfer of a Premises Licence and the Variation to a Premises Licence.

 

Decision:

 

That the application for a Transfer of a Premises Licence in respect of Clock Tower, 23 Torwood Street, Torquay TQ1 1ED be deferred until 31 October 2013 to enable the Applicant to attend.
