The Committee considered the submitted report and recommended amendments to the Licensing Policy for 2021-2026.  It was noted that accordance with Section 5 of the Licensing Act 2003 (the Act), Torbay Council (the Council) was required every 5 years, to review and republish its Statement of Licensing Policy (the Policy).  The current Policy was published on 7 January 2016 and therefore, it must be reviewed and re-published, on or before 6January 2021. 

 

Members’ attention was also drawn to take into account that the Cumulative Impact Policy (CIP) now stands alone from the Policy, following a change in legislation.  This would now be required to be reviewed every 3 years and therefore, would run from 2021 to 2024.  The submitted Report therefore, also introduced the revised draft CIP 2021 to 2024, which was being consulted alongside the draft Policy.

 

The submitted report included the proposed revisions and the Committee were requested to comment on its content. 

 

Resolved:

 

That the Policy be recommended for approval subject to:

 

(i)            Any grammatical errors being submitted to the Principle Licensing Officer;

(ii)          The inclusion of a glossary or similar explaining abbreviations;

(iii)         With 3.1 the addition of text in respect of trafficking, money laundering, financial abuse and modern slavery;

(iv)         Delegated authority be granted to the Principal Licensing Officer to include in the Policy, when appropriate, national schemes such as ‘Ask for Angela’ or ‘Ask for Clive’;

(v)          Within the Policy clarity in Appendix 2 in respect over door supervisors being self-employed or employed;

(vi)             Within appendix 2 a change from the ‘deployment’ of SIA to the ‘provision of’; and

(vii)           Within appendix 4 inclusion of ‘sexual violence’.
