The Minutes of the meeting of the Development Management Committee held on 12 February 2018 were confirmed as a correct record and signed by the Chairman.

Formation of supermarket including associated works.

Minutes:

The Committee considered an application for formation of supermarket, including associated works.

 

Prior to the meeting written representations were available on the Council’s website.  At the meeting Matthias Daly addressed the Committee in support of the application.

 

Resolved:

 

(i)               that the application be approved subject to satisfactory drainage details being delegated to the Executive Head of Assets and Business Services, and the completion of a Section 106 agreement in respect of:

a)           the current store (or a replacement store of similar size within Paignton town centre as defined by the most recently adopted development plan) remaining open for 5 years from the subject store at White Rock opens for trading;

b)           a financial contribution of £17,000 for Traffic Orders and the installing of appropriate signage and road markings for:

          prohibition of goods vehicles restriction to the south side of Waddeton Close;

          a 30mph speed limit on Waddeton Close;

          a loading ban and double yellow lines on White Rock Way;

          revoking traffic orders on Waddeton Close which are extant at the date of the deed.

 

(ii)             the final drafting of conditions, including those set out in the submitted report, being delegated to the Executive Head of Assets and Business Services with the addition of:

a)           road to be constructed in accordance with Torbay Council’s Highways Design Guide (roads built to adoptable standard) with drawings submitted and approved in writing by the Local Planning Authority; and

b)           that deliveries do not take place between 23:00 and 08:00.

The Committee considered an application for an outline application for 46 new apartments with below ground parking with all matters reserved except for access (as revised by plans received 13.01.2018).

 

Prior to the meeting, Members of the Development Management Committee undertook a site visit and written representations were available on the Council’s website. 

 

Resolved:

 

Approved, subject to:

 

(i)        the final drafting of conditions, to include those set out in the submitted report (and to include compliance with the addendum drainage detail submitted), being delegated to the Executive Head of Assets and Business Services; and

 

(ii)        the completion of a Section 106 Agreement in accordance with the adopted Affordable Housing Supplementary Planning Document to secure a review of the financial viability of the scheme and payment of a financial contribution towards affordable housing if viability improves.
