Decision:
That
1) the Statutory Licensing Sub-Committee be established with the following Terms of Reference and held on 30 May 2024 at 9.30 am:
To consider and determine all matters in connection with licensing applications (including those set out in the Statement of Licensing Policy and Gambling Act Policy/Statement of Principles); and
2) the Head of Governance Support be authorised to empanel to Statutory Licensing Sub-Committee three elected and trained Councillors and therefore not politically balanced.
Reasons for the decision:
The Statutory Licensing Sub-Committee considers new applications, applications to vary Premises Licences and applications for review of Premises Licences under the Licensing Act 2003 have to be heard within 20 working days after the completion of their 28 day statutory consultation period. Two applications have been received and are legally due to be heard before Adjourned Annual Council will meet on 20 June 2024.
A hearing is therefore needed to comply with our statutory responsibilities, which will be exceeded if there is a delay in the Statutory Licensing Sub-Committee being convened. This will potentially affect the interests of those businesses.

Information:
At the Annual Council meeting on 16 May 2024 the decision was taken to adjourn the meeting and therefore the remainder of the business due to be considered. The Council was due to consider the establishment and appointment to Council Committees and Working Parties, this was not undertaken, and Committee meetings scheduled between 16 May 2024 and 20 June 2024 have, in the main, been rescheduled or cancelled. The exception being the Statutory Licensing Sub-Committee on 30 May 2024 which has business that needs to be transacted before the Adjourned Annual Council meeting on 20 June 2024. Therefore, the Chief Executive has exercised her delegated powers in accordance with Paragraph 1.19 of the Officer Scheme of Delegation to appoint the Statutory Licensing Sub-Committee to enable it to meet on 30 May 2024 to determine the business before them.
