Decision:

That the following decision taken on 17 December 2018 be rescinded:

 

That the Assistant Director for Business Services and the Elected Mayor, be authorised to agree and sign the final Memorandum of Understanding (MOU) between Torbay Council and Torquay United Association Football Club (TUAFC) based on the draft MOU set out at Appendix 1 to the submitted report.

Reasons for the decision:

Torquay United Association Football Club (TUAFC) have indicated to the Elected Mayor that, following a meeting with Group Leaders, they are satisfied that the Council already has sufficient arrangements in place to support their proposal to invest financially in developing a new stadium and providing improved sports provision for young people to enhance the work already undertaken by TUAFC and therefore the Memorandum of Understanding is not required.

Alternative options considered:

To implement the original decision and take any action as agreed by the Overview and Scrutiny Board.

Implementation:

This decision may come into force immediately.

Information:

At the meeting of the Policy Development Group (Joint Operations Team) held on 17 December 2018, the Elected Mayor considered the submitted report and agreed to enter into a Memorandum of Understanding between Torbay Council and Torquay United Association Football Club (TUAFC) based on the draft MOU set out at Appendix 1 to the submitted report to enable them to develop proposals for a new stadium and improved sports provision for young people.

 

The Elected Mayor’s decision was called in and was considered at the meeting of the Overview and Scrutiny Board held on 16 January 2019.  Following further discussion with TUAFC, the Elected Mayor advised the Overview and Scrutiny Board that he was minded to rescind his original decision prior to the call-in meeting, however, Standing Order D9.7 states that ‘no further action will be taken in respect of the decision or its implementation save in accordance with this Standing Order or (if appropriate) Standing Order D10.’  The call-in meeting has now been held and the Elected Mayor’s decision is set out above.
