The Minutes of the meeting of the Statutory Licensing Committee held on 24 October 2024 were confirmed as a correct record and signed by the Chairman.

Members considered the draft ‘Licensing Act 2003 – Draft Licensing Statement of Principles 2026 – 2031’ which had been released for public consultation.  The Regulatory Services Manager informed Members that the Council was required to review and publish the Licensing Act 2003 – Draft Licensing Statement of Principles every five years.  Members were advised that the document forms part of the Council’s Policy Framework with final ratification of the policy being a full Council function, the Licensing Committee in this instance was a consultee. 

 

The Policy sets out the statutory licensing framework governing the sale of alcohol, the provision of regulated entertainment, and the operation of premises offering late-night refreshment.

 

Alcohol plays a significant role in Torbay’s economy, particularly within the evening and night-time sectors. However, its consumption can adversely affect individuals, families, and local communities, as well as the broader wellbeing of Torbay. As such, its use must be carefully regulated and managed.

 

The Regulatory Services Manager provided details of the changes that were proposed to the policy.  

 

Resolved (unanimously):

 

That Cabinet be recommended to approve the Draft Licensing Statement of Principles 2026-2031 subject to Cabinet considering any other consultation responses.

The Committee considered the Mediation report that provided information on the delegated decisions for the grant/variation of premises licences. 

 

The Regulatory Services Manager responded to Members questions.

That the Licensing Committee notes the Mediation Report on the delegated decisions for the grant/variation of premises licences.
