Representation objecting to the application on the grounds of the ‘Prevention of Crime and Disorder’ and the ‘Prevention of Public Nuisance’.

Additional Information:

 

The Senior Licensing Officer informed Members that the required notices regarding the hearing had been sent to the Applicant and Objector.  However the Objector had not returned their notice, Members therefore confirmed that the hearing should proceed in the absence of the Interested Party.

The Applicant outlined the application for a Premises Licence and responded to Members questions.

 

Decision:

 

That the application for a Premises Licence in respect of Il Pomodoro, Unit 5, Victoria Square, Paignton be approved as applied for, subject to the following two additional conditions:

 

i)        That no new patrons shall be permitted on the premises after 10 pm; and

 

ii)       A4 size notices shall be displayed at exit points of the premises advising its patrons to respect its nearby residents and leave the premises quietly.

 

Reason for Decision:

 

Having carefully considered all the oral and written representations, Members resolved to grant the Licence having been satisfied that the application along with the additional conditions would promote the Licensing Objectives.

 

In coming to their decision, Members noted that the Applicants intention is to run the premises as an eatery and not that of a vertical drinking establishment.

 

In concluding, Members noted there were no representations in respect of this application from any Responsible Authority.
