Additional Conditions

ANNEXE 1
MANDATORY CONDITION: WHERE LICENCE AUTHORISES SUPPLY OF ALCOHOL

1)       No supply of alcohol may be made under the premises licence:-

()        at a time where there is no designated premises supervisor in respect of the premises licence , or

()        at a time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended.

2)              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
MANDATORY CONDITION: DOOR SUPERVISION

1)       Where one or more individuals are carrying out security activities, each individual must be licensed by the Security Industry Authority.

2)       But nothing in the aforementioned conditions requires such a condition to be imposed in respect of a) and b) and (b)(i) and (b)(ii)

()        in respect of premises within paragraph 8(3)(a) of Schedule 2 to the Private Security Industry Act 2001 (c. 12) (premises with premises licences authorising plays or films), are exempt.

()        In respect of premises in relation to-
()        any occasion mentioned in paragraph 8(3)(b) or (c) of that Schedule (premises being used exclusively by club with club premises certificate, under a temporary event notice authorising plays or films or under a gaming licence), or
()        any occasion within paragraph 8(3)(d) of that Schedule (occasions prescribed by regulations under that Act).

3)              For the purposes of the aforementioned conditions:-

()        “security activity” means an activity to which paragraph 2(1)(a) of that Schedule applies, and

()         paragraph 8(5) of that Schedule (interpretation of references to an occasion) applies as it applies in relation to paragraph 8 of that Schedule.
ANNEXE 2

CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
General

1.              Door supervisors shall wear high visible jackets.

2.              The premises shall join Torquay Night Time Economy Forum with management to attend at least 2 meetings per calendar year.

The Prevention of Crime and Disorder

1.              The Licensee shall maintain the existing CCTV system.

2.              The Licensee shall retain recordings for 31 days, which shall be delivered to the Police on request (subject to the Data Protection Act 1988).

3.              Staff shall be instructed that persons who look under 18 years must be asked for identification before they will be sold alcohol.

4.              The only identification that shall be accepted shall be that approved by PASS, photo driving licences or passports.

5.              Sufficient SIA licensed door staff shall be employed to control customers in, arriving at and leaving the premises.

6.              All staff shall receive suitable training in order to meet with the requirements of the Licensing Act 2003.

7.              There shall be no irresponsible drinks promotions (e.g. all you can drink for £10).

8.              Substantial food and non-alcoholic drinks shall be available throughout the trading hours for sale of alcohol.

9.              Alcohol shall only be consumed in the area shown outlined green on the approved plan.

10.              Where customers take drinks outside; are watching specially organised live or recorded televised sporting events or are attending an especially busy event at the premises, drinks shall be provided in plastic or toughened/safety pint and half pint glasses.

Public Safety

1.              The maximum number of persons who can be accommodated on this site shall be 820. This figure shall not be exceeded without express permission from the Fire and Environmental Health officers.

2.              Arrangements shall be made to ensure that any capacity limit set for the premises can be properly monitored. Information regarding the capacity should be given to an authorised officer on request.

3.              No alteration which would result in it being impossible to comply with an existing licence condition shall be made without first seeking variation of the Premises Licence to delete or amend the condition(s) in question.

Prevention of Public Nuisance

1.              Notices shall be displayed at the exits requesting customers to respect the needs of local residents and to leave the premises and the area quietly.

2.              No rubbish, including bottles, shall be moved, removed or places in outside areas between 19.00 hours and 09.00 hours.

3.              Insofar as it is within the operator's control, no collection of goods or disposal of waste shall take place between 19.00 hours and 09.00 hours.

4.              Speakers shall not be positioned outside.

5.              When musical entertainment is offered at the site after 22.00 hours, management shall ensure regular monitoring in the vicinity of the premises to establish if there is noise breakout from the premises.

6.              Where necessary, steps shall be taken to minimise the extent of noise breakout from the premises to prevent disturbance to local residents.

The Protection of Children From Harm

1.              Under 18's shall not be permitted in the premises if the style of entertainment offered or operation is not conducive.

2.              Under 18's shall not be permitted on the premises in any event after 22.00 hours.
ANNEXE 3

CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
The Prevention of Crime and Disorder

1.              On every occasion that the premises sells alcohol after midnight and then closes after 12.30am, SIA door staff shall be employed from 10.00pm until closing.

2.              All drinks must be served in toughened or strengthed glasses and no alcohol shall be served in glass bottles from which it is intended or likely that a person shall drink.

3.              There must be no entry or re-entry to premises after 2am.

Public Safety

1.              The ratio of stewards to customers on the premises shall be no less than 1:75.

The Prevention of Public Nuisance

1.              Noise from the premises shall not be auidble within any dwelling with windows open for normal ventilation especially after 11pm. This shall be assessed from the boundary to the nearest residential properties, on all sides of the licensed premises. The criteria that shall be applied are:-
              (i)              Before 11pm - Noise emanating from the premises shall not be clearly distinguishable above other noise.
              (ii)              After 11pm - Noise emanating from the premises shall not be distinguishable above background levels of noise.
              (iii)              The local authority shall reserve the right in cases of tonal noise and where premises are attached to others, to make further assessments from within the residential               property.

2.              A senior member of staff (manager) shall assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment to ensure levels of noise have not increased.

3.              A noise limitation device shall be in operation controlling the system to which an amplification equipment is fitted. This device shall be regularly maintained to ensure that the noise produced with the premises shall not be audible within any residential premises in the vicinity.

4.              To allow live and amplified music inside doors and windows shall be kept shut during entertainment to reduce noise breakout. A management scheme shall be in place to ensure this situation remains.
