  ANNEXE 1

   

   

  MANDATORY CONDITION:  WHERE LICENCE AUTHORISES SUPPLY OF ALCOHOL

   

  1)       No supply of alcohol may be made under the premises licence:-
   

  ()                      (a) at a time where there is no designated premises supervisor in respect of the premises licence , or
   

                (b) at a time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended.

   

  2)              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  3)                            (1)  The responsible person shall take all reasonable steps to ensure that staff on relevant  premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

                              (2)   In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -

   

                (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -

   

                (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

   

                (ii)   drink as much alcohol as possible (whether within a time limit or otherwise);

   

                (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as  defined in section 159 of the Act);

   

                (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

   

                (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on -

   

                (i)        the outcome of a race, competition or other event or process, or

   

                (ii)               the likelihood of anything occurring or not occurring;

   

                                            (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the  vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti social behaviour or to refer to the effects of drunkenness in any favourable manner.

   

  4)              The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

   

  5)              The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

   

  6)                            (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

   

                (2) The policy must require individuals who appear to the responsible person to be under 18 years of  age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

  7)              The responsible person shall ensure that -

   

                (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures     -

   

                (i) beer or cider: ½ pint;

   

                (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

   

                (iii) still wine in a glass: 125 ml; and

   

                (b) customers are made aware of the availability of these measures.

  ANNEXE 2

   

  CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  General

   

  1.              Substantial food and beverages, other than intoxicating liquor (including drinking water) shall be available during the whole of the permitted hours in all parts of the premises where intoxicating liquor is sold or supplied.

   

  2.              The Designated Premises Supervisor and Licence Holder shall be a participating member of a Torquay / Torbay Licensing Forum.

   

  3.              Continuous coaching of the team and monitoring of all objectives through weekly and period meetings

   

  The prevention of crime and disorder

   

  1.              CCTV will be provided in the form of a record-able system, capable of providing pictures of evidential quality in all lighting conditions particularly facial recognition. Cameras shall encompass all ingress and egress to the premises, fire exits all areas where the public have access, any external drinking area’s. Equipment must be maintained in good working order, the system must continually record whilst the premises is open for licensable activities and during all times when customers remain at the premises. Recordings must be correctly timed and date stamped, recordings must be kept in date order, numbered sequentially and kept for a period of 31 days and handed to a Police Officer/Local Authority Officer on demand. The Premises Licence Holder must ensure that at all times a Designated Premises Supervisor (DPS) or appointed member of staff is capable and competent at downloading CCTV footage in a record-able format either disc or VHS to a Police Officer/Local Authority Officer on demand. The Recording equipment and tapes/discs shall be kept in a secure environment under the control of the DPS or other responsible named individual. An operational daily log report must be maintained, endorsed by signature, indicating the system has been checked and is compliant. In the event of any failings the actions taken are to be recorded. In the event of technical failure of the CCTV equipment, the Premises Licence holder/DPS must report the failure to the Police/Local Authority.

   

  2.              An incident recording book, bound in numerical order, shall be maintained at the premises showing details of the date and time of all assaults, injuries, accidents or ejections, as well as details of the members of staff involved, the nature of the incident and the action/outcome. The book must be kept available for inspection by the Police and authorised officers of the Licensing Authority.

   

  3.              Other than for off sales in sealed containers no drinks are permitted to leave the licensed area as shown on the deposited plans.

   

  4.              Regular toilet checks to be conducted for the purposes of drug prevention and the timings of such visits shall be recorded.

   

  5.              Managers/supervisors of premises to attend and fully participate in the Local Pub and Club Watch scheme or any like scheme

   

  6.              Suitable non glass receptacles only to be used at premises on days considered to be major event days in the area. Such days to be notified to designed premises supervisor in writing at least 14 days prior to event, or with agreement of Pub and Club Watch.

   

  7.              We have taken into consideration the use of door security, but when taken into account the CCTV system that we use and the fact that during late night trading there is always a manager on duty, that patrols the business, along with a team of between 5 and 6, we currently believe that we are and have taken every precaution to ensure the  prevention of crime and disorder. The situation would be reviewed when needed. 

   

  Public safety

   

  1.              The premises will be maintained in a safe manner at all times.

   

  2.              All exits will be kept unobstructed, easy to open and clearly signed.

   

  3.              No customers carrying any form of alcoholic drink, open, will be admitted to the premises at any time.

   

  4.              The premises operators will accept any and all training provided by Torquay / Torbay Police in regard to Vulnerability Training for staff members.

   

  The prevention of public nuisance

   

  1.              The supply of alcohol at the premises shall only be to a person seated taking a table meal there and for consumption by such a person as ancillary to their meal.

   

  2.              Substantial food and non-intoxicating beverages shall be available in all parts of the premises where alcohol is sold or supplied for consumption on the premises.

   

  3.              Notices shall be prominently displayed at all exits requesting patrons to respect the needs of local residents and leave the area quietly.

   

  4.              Notices shall be prominently displayed at any area used for smoking requesting patrons to respect the needs of local residents and use the area quietly.

   

  5.              There shall be no outside drinking at the premises other than by customers seated within an area covered by a pavement cafe licence.

   

  6.              Any external areas to be clearly identified and enclosed by use of a barrier method.

   

  7.              External areas to be regularly supervised by staff from the premises when in use.

   

  8.              The license holder shall ensure that any queue to enter the premises which forms outside the premises is orderly and supervised, so as to ensure that there is no public nuisance or obstruction to the public highway.

   

  9.              No glass, including bottles, shall be moved, removed or placed in outside areas between 2300 hours and 0800 hours.

   

  10.              When trading past 2300hrs, a member of staff from the premises to clear the immediate area outside the premises of any Campana food or drink related litter. This litter collection to take place every 60 minutes throughout the time the premises is open and trading.

   

  The protection of children from harm

   

  1.              A Challenge 25 proof of age scheme, shall be operated at the premises where the only acceptable forms of identification shall bear their photograph, date of birth and a holographic mark.

   

  2.              A log shall be kept detailing all refused sales of alcohol. The log should include the date and time of the refused sale and the name of the member of staff who refused the sale. The log shall be available for inspection at the premises by the police or an authorised officer of the Council at all times whilst the premises are open.

   

  3.              No persons under the age of 18 years shall be permitted inside the premises between the hours of 2300 to 0500 unless accompanied by a responsible adult.
