Additional Conditions

• MANDATORY CONIDTION: DOOR SUPERVISION

  1.              Where one of more individuals are carrying out security activities, each individual must be licensed by the Security Industry Authority

   

  2.              But nothing in the aforementioned conditions requires such a condition to be imposed in respect of a) and b) and (b)(i) and (b)(ii)

   

  (a)              in respect of premises within paragraph 8(3)(a) of Schedule 2 to the Private Security Industry Act 2001. (c. 12) (premises within premises licences authorising plays or films), are exempt.

   

  (b)              In respect of premises in relation to-

  (i)              any occasion mentioned in paragraph 8(3)(b) or (c) of that Schedule (premises being used exclusively by club with club premises certificate, under a temporary event notice authorising plays or films or under a gaming licence), or

  (ii)              any occasion within paragraph 8(3)(d) of that Schedule (occasions prescribed by regulations under that Act).

   

  3.              For the purposes of the aforementioned conditions:-

  (a)              “security activity” means an activity to which paragraph 2(1)(a) of that Schedule applies, and

  (b)              paragraph 8(5) of that Schedule (interpretation of references to an occasion) applies as it applies in relation to paragraph 8 of that Schedule.

  MANDATORY CONDITION:  WHERE LICENCE AUTHORISES SUPPLY OF ALCOHOL

   

  1)       No supply of alcohol may be made under the premises licence:-
   

  ()        at a time where there is no designated premises supervisor in respect of the premises licence , or
   

  ()        at a time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended.

   

  2)              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  3)              .               (1)  The responsible person shall take all reasonable steps to ensure that staff on relevant  premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

                                   (2)   In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children -

   

                                   (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -

   

                              (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

   

                        (ii)   drink as much alcohol as possible (whether within a time limit or otherwise);

   

                            (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as  defined in section 159 of the Act);

   

                                (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

   

                      (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on -

   

                                 (i)        the outcome of a race, competition or other event or process, or

   

                                  (ii)               the likelihood of anything occurring or not occurring;

   

                  (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the  vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti social behaviour or to refer to the effects of drunkenness in any favourable manner.

   

  4)              The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

   

  5)              The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

   

  6)                             (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

   

                                     (2) The policy must require individuals who appear to the responsible person to be under 18 years of  age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

  7).               The responsible person shall ensure that -

   

                            (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures     -

   

                                (i) beer or cider: ½ pint;

   

                                (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

   

                                (ii) still wine in a glass: 125 ml; and

   

              (b) customers are made aware of the availability of these measures.

   

   

   

•  

  MANDATORY CONDITION:  EXHIBITION OF FILMS

   

  1)       Where the film classification body is specified in the licence, admission of children must be restricted in accordance with any recommendation made by that body.

   

  2)       Where -

   

  ()        the film classification body is not specified in the licence, or
   

  ()        the relevant licensing authority has notified the holder of the licence that this condition applies to the film in question,
   

  admission of children must be restricted in accordance with any recommendation made by that licensing authority.

   

  In the case of the aforementioned conditions

                “children” means persons aged under 18; and

                “film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (authority to determine suitability of video works for classification).

  ANNEXE 2

   

  CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

•  

  General

  1.              Rowcroft shall have regular meetings with emergency services and through the Public Safety Advisory Group, Torbay Council departments and other agencies to plan for and share information regarding each event, implementation, environmental issues and cleansing.

  2.              All events shall be planned taking into consideration the guidelines laid down in the HSE’s Event Safety Guide ISBN 07176245536.

  3.              Rowcroft shall work closely with all Agencies and private security with the aim to achieve a safe environment.

  4.              The event organiser or designated deputy must be on site at all times during the event.

  5.              The event organiser must inform the Emergency Services of the event.

  6.              Barriers must be used in accordance with event type and size for safety and crowd control.

  7.              Toilets and catering facilities shall meet necessary requirements.

  8.              There shall be facilities to have announcements as laid out in the guidance notes.

  9.              Provisions shall be made for the disabled.

  10.              Rowcroft must ensure that any promoter, performer, trader or other person connected to the event does not breach or permit or contribute to any breach of any term, condition or restriction of this licence before, during and after the event.

  11.              A copy of the premises must be displayed in a conspicuous position on the premises and available at all times for inspection by the Police, Fire authority and authorised officers of the Council.

   

  The Prevention of Crime and Disorder

  1.              Sufficient numbers of security staff and stewards who are fully trained shall be provided on the premises.

  2.              A register of staff, including security staff, working at the premises whilst the public is present shall be maintained.

  3.              Rowcroft shall have SIA registered private security contracted as necessary, with appropriate levels of staffing and event.

  4.              Security and management shall have radios to enable effective communication.

  5.              The communication equipment shall be kept in working order at all times that the premises are open to the public ensuring that all instances of crime and disorder are reported to an agreed Police contact.

  6.              Only plastic glasses shall be used and extra security shall be hired as required.

  7.              The event organiser shall liaise with Police and keep the authorities fully informed regarding programme of events.

  8.              Any Police instruction / directions shall be compiled with whenever given.

  9.              There shall be a central control point on site for emergency services, security, event organisers and council officers to liaise.

  10.              Events shall be planned in accordance with HSE Guidance.

  11.              There shall be designated control points for emergency services and event organisers to liaise.

  12.              As a condition of entry to the site, persons shall consent to being searched, search to be away from public view where possible. Refusal to be searched shall resort in refused entry.

  13.              Incident log shall be maintained and kept on premises and available for inspection by responsible authorities.

   

  The Promotion of Public Safety

  1.              The event organiser shall adhere to the HSE Event Safety Guide regarding first aid levels, Police, security and public provision.

  2.              Rowcroft shall have a safety plan for control of large crowds in compliance with the licensing act, a management structure and risk assessment and emergency plan agreed with relevant authorities.

  3.              All staff shall have received suitable training as to what to do in an emergency and in general safety precautions.

  4.              Consideration shall be given to ensure the maximum occupancy levels are controlled. All persons shall be counted in and out of the premises. There shall not be more than 4999 persons on the site at any one time.

  5.              Adequate access shall be provided for emergency vehicles. Emergency points and hydrants shall be maintained.

  6.              Relevant codes of practice shall be followed regarding marquees, fireworks, laser shows and fire extinguishers.

  7.              On site health and safety inspections shall be carried out where necessary.

  8.              Where patrons wait in a queue for admission, all reasonable steps shall be taken to ensure that such persons do not obstruct exits.

  9.              Portable barriers / guards shall be available where queues for entry can be envisaged. These shall be arrangement so as to control patrons and keep the pavements clear.

  10.              Qualified first-aiders shall be present on the premises during the whole time the premises are made available for regulated entertainment.

  11.              Facilities and equipment suitable for the number of patrons and the type of event undertaken shall be provided to enable first-aid treatment to be given promptly in the event of injury to patrons or staff.

  12.              Persons shall not be allowed to stand, sit or otherwise remain in any gangway or exit way.

  13.              Lighting shall be provided where necessary and will meet requirements as set out in The Code of Practice for Outdoor Events and the HSE Event Safety Guide.

  14.              Smoking shall be prohibited within any enclosed area, including the stage area and notices shall be prominently displayed to this effect.

  15.              The area shall be closed to the public during the site build and load out.

  16.              No work in connection with any alterations or repairs in areas occupied by the public or performers shall be carried out whilst the public are on the premises.

  17.              The staff altering system shall be maintained in working order.

  18.              Only reputable contractors shall be used to provide temporary structures that confirm to current regulations.

  19.              Checks shall be made on contractor’s documentation i.e test certificates, food hygiene and insurances.

   

  The Prevention of Public Nuisance

  1.              The event organiser shall liaise with Environmental Health and comply with any directions given.

  2.              Where possible, stage and sound speakers shall be positioned to face out to sea in consideration of local residents.

  3.              The sound level shall be agreed and set by Torbay Council with the organisers prior to the start of the event. Sound levels shall be monitored regularly. The event organiser or designated deputy shall be on site at all times and shall have the power to reduce sound levels if required.

  4.              The event organiser or designated deputy shall be contactable via mobile telephone at all times during the event. This contact number shall be given to all emergency services and relevant Council offices including environmental health prior to any planned event.

  5.              Construction and derig of events shall not be carried out at an unsocial able hour (between 23:00 & 7:30)

  6.              If in use at all, only silent generators shall be used overnight.

  7.              A wind down period shall be calculated for during the programming of events to allow for public dispersal.

  8.              As far as is practical, persons on or leaving the premises shall be reminded to conduct themselves in an orderly manner and not to cause annoyance to residents or persons passing by.

  9.              Facilities for depositing litter and the collection of litter generated by patrons shall be available and maintained.

  10.              All the rubbish produced by the premises shall be stored securely in a designated area - This shall help prevent litter being blown around.

  11.              Litter picking teams shall be on duty throughout the event to keep the site clear. Post event litter arrangements shall be in place for litter picking and waste removal.

  12.              The event organiser shall liaise with Police, Torbay Council’s Highways department and Parking Services regarding implementation of traffic arrangement plans.

   

  The Protection of Child from Harm

  1.              There shall be a lost children’s point on site and facilities to have announcements as laid out in guidance notes.

  2.              The event organiser shall liaise with Police and Children’s Services and comply with any directions given.

  3.              A register of all staff, including security staff, working at the premises whilst the public is present shall be maintained.

  4.              When on duty event attendant shall wear a uniform, distinctive dress or armband and no person under the age of sixteen shall be employed as an attendant on the premises.

  5.              Any persons working with children on site shall be interviewed and reference checked. Where there are activities available to children that do not require parental supervision, staff working with children shall be required to undertake an appropriate level of DBS check.

  6.              The sale of tobacco shall be prohibited at all events.

  7.              All entrants shall be given a wristband. These will be attached on a day and will only be removed by cutting off after event. Any under 18 year olds shall be given a different colour wristband.

  8.              A ‘Challenge 25’ policy shall be operated in relation to selling intoxicating liquids.

  9.     Adequate signage regarding restriction on underage drinking shall be displayed at the Premises area.
