  MANDATORY CONDITION:  WHERE LICENCE AUTHORISES SUPPLY OF ALCOHOL

   

  1)       No supply of alcohol may be made under the premises licence:-
   

  ()        at a time where there is no designated premises supervisor in respect of the premises licence , or
   

  ()        at a time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended.

   

  2)              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

  ANNEXE 2

   

  CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

• General

   

  1.              Existing Company procedures must be applied to the premises in relation to additional granted hours.  If procedures are reviewed copies must be forwarded to the Licensing Authority.

   

  The Prevention of Crime and Disorder

   

  1.              The Company must be committed to strict compliance with the law in the course of the operation of its premises and to maintaining good standards of behaviour by its customers. 

   

  2.              The measures identified in the Overview of Operations must be followed to meet the Prevention of Crime and Disorder objective outlined in sections A, B, C, D, E, F, G, I, J and L..  These measures must continue to apply to the additional hours granted by the Licensing Authority.

   

  Public Safety

   

  1.              JD Weatherspoon must undertake ongoing risk assessments in order to comply with Health and Safety legislation. 

   

  2.              The Overview of Operations must continue to identify certain areas from a licensing perspective which address the Public Safety objective, as outlined in sections A, B, C, E, G, I, J and L.

   

  The Prevention of Public Nuisance

   

  1.              The existing measures identified in the Overview of Operations must continue to apply, as outlined in sections A, B, C, D, E, F, G, I, J and L in the prevention of public nuisance.

   

  The Protection of Children From Harm

   

  1.              Chidlren must vacate the bar by 21.00 hrs unless they are eating in which case they shall be required to vacate the bar by 21.30 hrs.

   

  2.              Children must always be accompanied by an adult who shall be required to maintain constant supervision of them.

   

  3.              The measures identified in the Overview of Operations must be followd to ensure compliance with the Protection of Children From Harm objective, as outlined in sections A, B, C, D, G, I, J, K and L.

  ANNEXE 3

   

  CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY

   

•  

  The Prevention of Crime and Disorder

   

  1.              A CCTV system of an evidential standard must be installed to the satisfaction of the police, and the system to be in operation at all times the premises are open to the public.  All recordings from that system must be kept for a period of 31 days and the police to have access to recordings at any reasonable time.

   

  The Prevention of Public Nuisance

   

  1.              Cooking, noxious or persistent smells from the premises must not cause a nuisance to nearby properties.

   

  2.              The mechanical extract system installed within the kitchen shall operate in a manner so as not to cause a noise or odour nuisance to nearby residents.

   

  3.              Regular maintenance must be carried out on all plant and machinery to ensure that noise and odour disturbance from such sources is kept to a minimum.

   

  The Protection of Children From Harm

   

  1.              The Designated Premises Supervisor must ensure that at all times the cigarette vending machines are sited to ensure they can be supervised by members of staff.

   

  2.              The Designated Premises Supervisor must ensure that all AWP machines are sited to ensure they can be supervised by members of staff.

   

  3.              A management system must be introduced to ensure that staff are aware of the legal requirements relating to underage sales and in particular the prevention of sales from cigarette and vending machines to children under sixteen and the prevention from use of AWP machiens by those under eighteen.
