During September and October 2008 Torbay Council installed on street pay and display machines in the town centre areas of Torquay and Paignton.  These machines were installed after a consultation process which commenced in December 2007 and eventually following approval by the Mayor and Cabinet in April 2008.

Pay and Display Machine Locations

Blue Disabled Badge Users

Vehicles using a disabled blue badge to park are able to use on street pay and display bays free of charge.  They are also able to stay at the location for an unlimited amount of time.

House Removals

If there are parking restrictions outside of a property you are moving in to or out of, please contact Parking Services on 01803 207660 to inform us that this is happening.  Removals vehicles are able to park free of charge in on street pay and display bays for the duration of the move, however the Council must be given prior notice to the move date. Failure to inform the Council may result in the issue of a Penalty Charge Notice.

Other Vehicles

Goods vehicles used by Scaffolders when erecting scaffold or Flat Roofers using hot tar can park free of charge in on street pay and display bays for the duration of works being carried out, however prior notice must be given to the Council.  Failure to inform the Council may result in the issue of a Penalty Charge Notice.

Loading/Unloading

Loading and Unloading within on street pay and display bays is not permitted free of charge.   A Parking Dispensation Notice is available for goods vehicles and large deliveries.  Private and non goods vehicles must purchase a ticket from the pay and display machines adjacent to the on street bay.  Alternatively private and non goods vehicles can use double yellow lines or a loading bay to load or unload without making payment.

If you do not have access to the internet to complete an on-line application form and to make payment, please visit your local Connections office in Torquay, Paignton or Brixham where an application form and debit/credit card payment can be completed.  Please remember to check opening times.

Motorcycle Parking

Motorcyclists are able to park within on street pay and display bays free of charge provided the motorcycle is parked at right angles to the kerb on the white lines which demark each of the bays.  Parking this way  allows for other vehicles to still park within the designated bays and make payment at the machine.  ‘Maximum Stay’ and ‘No Return’ periods at each location must be adherred to also as failure to observe this will result in the issue of a Penalty Charge Notice.

If a motorcyclist wishes to place a motorcycle within a marked bay taking up the entire bay and purchase a ticket from the pay and display machine they can do so.  If the ticket can not be clearly displayed then the ticket can be kept on their person.  If a Penalty charge Notice is subsequently issued to the motorcycle the pay and display ticket can be provided as evidence of correct payment having been made.

Permits

Torbay Council car park permits and Health Emergency Badge (HEB) permits are not valid in any on street pay and display bays.  Failure to display a valid pay and display ticket purchased from the on street machines located adjacent to the bays at each location will result in the issue of a Penalty Charge Notice.

Enforcement

NCP Services are contracted to enforce all the parking restriction in Torbay.  Payment must be made at the pay and display machines in all the on street locations to avoid a Penalty Charge Notice being issued with the exception of the vehicles stated above.

There are parking restriction signs in the relevant streets stating payment is required, the maximum stay and return times as well as directing motorists to the relevant pay and display machines situated in the street by the use of directional arrows.  Before leaving a vehicle unattended the motorist should read the signs and the notice on the pay and display machines for terms and conditions.

When visiting on street pay and display parking bays, Civil Enforcement Officers will check the expiry time of tickets and vehicles.  If parking time has expired on the ticket purchased or a ticket is not displayed the Civil Enforcement Officer will check the nearest pay and display machine to see if a motorist is purchasing a ticket.  If no one is present at the pay and display machine a Penalty Charge Notice will be issued and notes made in the Civil Enforcement Officers pocket book to that affect.  If a motorist is in the process of purchasing a ticket from the nearest pay and display machine they will be given time to purchase the ticket and return to the vehicle to display the ticket and in these instances only, a Penalty Charge Notice will not be issued.

Any vehicles which park outside the bay markings overlapping in the next bay, preventing other motorists using that bay will be issued a Penalty Charge Notice if only one ticket has been purchased for one parking bay.

For large vehicles such as motor homes, two tickets must be purchased for two parking bays if the vehicle is too large to fit in one parking bay.  Civil Enforcement Officers may also issue Penalty Charge Notices where vehicles overlap the marked parking bays into the highway itself where an obstruction occurs.

Meter feeding is not permitted in any on street pay and display parking bays to extend the parking period beyond the maximum stay allowed at that location.   

Challenging the Issuing of a Penalty Charge Notice

If you wish to challenge the issuing of a Penalty Charge Notice to a vehicle, please write to or contact Torbay Council using the contact details provided on the reverse of the Penalty charge Notice issued to the vehicle.  Please do not ask the Civil Enforcement Officer to cancel it or take it back, as once the Penalty Charge Notice has been issued to a vehicle it can only be cancelled following a legislative process which involves a letter or email being sent to Torbay Council stating the reasons why the motorist feels it was issued in error.
