Excavating the Public Highway
There are two pieces of legislation that govern excavation in the Public Highway.
Installation of apparatus
- installation of sewer
- water service
- cables
These types of works are conducted under the provisions of New Roads and Street Works Act 1991 section 50.
Non apparatus excavation
- rebuilding structures adjacent to the public highway
- damp proofing property
- installation/maintenance of cellar lights
These types of works are conducted under the provisions of Highways Act 1980 section 171.
