Public Rights of Way Enforcement

One of the most important aspects of any right of way is that the public can access the route at any time.
The highway authority has a duty to ensure all Public Rights of Way are kept free of obstructions at all times and we have to take action against landowners or occupiers.

Enforcement Action

Whilst all public rights of way are inspected on a regular basis to ensure that they are unobstructed, Torbay Council does rely on the public to inform them of any obstructions that may affect their enjoyment of the route.  The Council would therefore encourage users to contact the Council to report any obstructions.
Most obstructions on Public Rights of Way can be resolved by notice or standard letter. Examples of these are an overgrown hedge, a locked gate, illegal notices, signs or barbed wire on gates.
