Torbay Local Development Framework

The Core Strategy and Torquay Harbour Area Action Plan documents which were recently out for consultation are still available to view on our Limehouse Consultation website and on the relevant web pages (See blue bar to the left).  Alternatively, reference copies are still available at the Council's Libraries, Connections Offices and at Roebuck House, Torquay.
The Strategic Planning Group will be considering comments over the next few months.  Comments will then be available to view online on the Limehouse Consultation page (link above).

What is the Local Development Framework?

The Planning and Compulsory Purchase Act 2004 came into force on September 24 2004. This Act heralded the replacement of the development plan system of structure plans and local plans with a system of Regional Spatial Strategies (RSSs) and Local Development Frameworks (LDFs). It is intended to equip planning to consider all matters that affect the use of land, rather than land use alone. This approach is called spatial planning.
To implement the new development plan system, the Council must prepare and monitor a three year management plan, known as the Local Development Scheme (LDS). The LDS is a public statement of the local planning authority's programme for the production of the Local Development Documents which comprise the LDF. The Torbay LDS was originally approved by the Council and submitted to the Secretary of State (Government Office for the South West) on 18 March 2005, in line with the requirements of the Act. However, upon the request of the Planning Inspectorate, the LDS has undergone minor amendments with regard to the list and timetabling of documents to be produced. This was resubmitted on 22 September 2005 and finally approved by Government Office for the South West on 14 November 2005. At its meeting on 15 December 2005, the Council resolved that the updated LDS should take effect from 16 December 2005.
A revised version of the LDS was submitted to GOSW on 29 March 2007. The revised Torbay Local Development Scheme March 2007 (March 2008 Update) is available to download (see Related Documents).  A further review of the LDS is imminent.

What is in the Local Development Framework?

The LDF consists of a 'portfolio' of documents. These are set out below. Collectively, these will provide and deliver the spatial planning strategy for Torbay for the period 2006 to 2026. For further details view the Local Development Framework Leaflet at the bottom of this page. DPDs and SPDs will be subject to formal Sustainability Appraisal. They will be supported by an evidence base of studies and technical documents, which can be found on the LDF Evidence Base page by clicking on the relevant text on the bar to the left.
A number of explanatory leaflets have been produced to provide a brief outline of each component of the Torbay Local Development Framework (see Related Documents).

Documents that have started to go through the formal process are available on this website where an outline of the purpose of the document and the stage that it has reached within the planning process is provided. It will also include pdfs of any documents that have been produced to date for consultation purposes.

What is the relationship of the Local Development Framework with other Council strategies?
The new spatial planning system is intended to relate closely to community plans. Accordingly, the Torbay LDS has been drawn up to reflect the spatial planning aspirations of the Torbay Community Plan as well as those of the relevant Council Business Units.
