Pre-Application Advice

Torbay council actively promotes the use of pre-application discussions prior to the submission of a formal planning application.  We would recommend the use of pre-application for the larger scale projects, such as major developments.

If you would like to obtain the council’s view on any proposal, please submit in writing a description of the proposal as well as a site location plan and any additional drawings you feel relevant.

How Do I Make A Planning Application?

The Consultation Process and Making Comments

Planning Applications have a statutory 21 calendar day consultation period, for comments to be received in respect of the application.  On the first day of the period, a site notice is placed as close to the site as possible as well as an advertisement appearing in the local newspaper (in Torbay’s Case this will be the Herald Express).  Properties which are adjoining the development will normally be notified by letter at the same time, however, on occasions this may be avoided due to the vast numbers needing to be informed.

You can make comments either in writing to this department or alternatively access our online planning facility and make a comment on there.

If you also provide us with an email address, once a decision has been reached, you will be notified of the decision made.

We also provide a ‘ward alert email system’, which sends a weekly email about any new or decided application within a specific ward.

Appeals Process and How to Make an Appeal

If the applicant is not happy with the decision made by the local authority, they have the right to appeal.  The appeal is administered by the Planning Inspectorate on behalf of the Secretary of State for Communities and Local Government.
