Application for a Provisional Statement
The application process is very similar to make an application for a Premises Licence. The key difference is that the applicant does not need to demonstrate that they have a right to occupy the premises to which the application relates.
The key difference is once a Provisional Statement is granted, and when an application is made for a Premises Licence, the Licensing Authority shall disregard representations unless they think they address matters that could not have been addressed in relation to the application for the Provisional Statement, or reflect a change in the applicants circumstances. I.e. the representations are from people who have recently moved into the location or the layout of the new premises has changed significantly from the original.
The application process is otherwise the same, see details under ‘Application for a New Premises Licence’, with the exception that the forms are different, see document below to download the relevant information.
The application forms for a Provisional Statement are Form R ‘Application for a Provisional Statement to be granted under the Gambling Act 2005 - Standard’ and Form S ‘Application for a Premises Licence to be granted under the Gambling Act 2005 - Vessel’ (are on the right hand side of this page).
Notices to responsible authorities’ forms are Form T for ‘Notice of application for a Provisional Statement - single applicant’ and Form U for ‘Notice of application for a Provisional Statement - multiple applicants’ (are on the right hand side of this page).
Form V for the ‘Notice for advertisement required for a Provisional Statement application’ (is on the right hand side of this page).
