Cooling Towers and Evaporative Condensers Notification

If you control notifiable devices such as cooling towers or evaporative condensers in a  non-domestic premises you must ensure that you notify Torbay Council.
The prime purpose of this is to identify potential areas that could give rise to spread of infectious disease e.g. legionella and to ensure preventative measures are taken to eliminate the risk of such infection arising to employees and the public.
Notification must be in writing (including by electronic means) on a form approved by the Health & Safety Executive.
You must also notify Torbay Council, in writing, of any changes to the notification information within one month of the change.
If the device ceases to be a notifiable device you must notify Torbay Council, in writing, as soon as possible.

Regulation Summary

All premises where cooling towers and evaporative condensers are situated must register with the local authority under The Notification of Cooling Towers and Evaporative Condensers Regulations 1992.It is an offence to operate cooling tower and evaporative condensers without notifying Torbay Council.
An operator must also notify Torbay Council of any changeshave been made since the original notification.  

Is the Licence Granted Automatically?

Yes. This means that you will be able to act as though your application is granted if you have not heard from Torbay Council within 28 days.
