Excavating the Public Highway

There are two pieces of legislation that govern excavation in the Public Highway.

Installation of apparatus

• installation of sewer
• water service
• cables

These types of works are conducted under the provisions of New Roads and Street Works Act 1991 section 50.

Non apparatus excavation

• rebuilding structures adjacent to the public highway
• damp proofing property
• installation/maintenance of cellar lights

These types of works are conducted under the provisions of Highways Act 1980 section 171.
